TERMS OF USE

Right of withdrawal

A natural person who wishes to purchase, purchases, or might purchase or use goods or services for a purpose unrelated to economic or professional activity (hereinafter referred to as the consumer) may, pursuant to Paragraph 19 of the Republic of Latvia Cabinet Regulation No. 255, “Regulations Regarding Distance Contracts,” exercise the right of withdrawal and return the purchased goods within 14 calendar days of making the purchase.

To exercise this right of withdrawal, you must inform SIA “Be More” of your decision to withdraw from the aforementioned distance contract by sending a request electronically to [email protected] or in writing to Rudzu iela 25, Dreiliņi, Stopiņu novads, LV-2130, Latvia.

Sending the request within the specified period releases the consumer from all contractual obligations relating to the distance contract. The consumer must return the goods to the seller within seven days of sending the withdrawal form or request (as determined by the date the email was sent or the postmark). After the goods are returned, the seller assesses their condition, prepares a refund document, and sends it electronically in reply or to the address provided. If the consumer approves the contents of the refund document, the seller must refund the amount paid for the goods within seven days of receiving that approval.

Please note that the consumer cannot exercise the right of withdrawal if:

  • the price of the goods or services depends on fluctuations in the financial market that the seller cannot control and that may occur during the withdrawal period;
  • the goods are made to the consumer’s specifications or are clearly personalized;
  • the goods are liable to deteriorate rapidly or expire soon;
  • the consumer has opened the packaging of goods that cannot be returned for health or hygiene reasons;
  • due to their nature, the goods have become irreversibly mixed with other parts of the goods after delivery (for example, two acrylic paints supplied separately in the same package have been mixed);
  • the consumer has requested that the seller or service provider visit to carry out urgent repairs or maintenance. If, during that visit, the seller or service provider provides additional services or supplies goods other than the spare parts necessary for the repairs or maintenance, the right of withdrawal applies to those additional services or goods;
  • the consumer has opened the packaging of an audio recording, video recording, or computer software (including software for handheld computers, navigation devices, etc.);
  • the contract concerns the supply of digital content not supplied on a tangible medium, and supply has begun with the consumer’s prior express consent and acknowledgment that they will lose the right of withdrawal.

Our recommendations to avoid misunderstandings:

  • When receiving the goods, make sure they fully match your order in manufacturer, model, color, size, and other essential characteristics. The right of withdrawal does not apply to goods delivered by courier if a scratch or other mechanical damage is found but was not reported immediately upon receipt. If you notice visible damage to the packaging, please ask the courier to record it on the delivery note. This will help resolve the matter quickly if the goods themselves were also damaged during delivery. You have the right to refuse goods at the time of delivery if their packaging is damaged or they appear suspicious.
  • Inspect the goods, but do not use them.
  • Do not open the packaging of audio recordings, video recordings, or computer software.
  • Keep the goods’ original packaging and all included items intact.

If the consumer exercises the right of withdrawal for a reason unrelated to the goods or services failing to conform to the contract, the consumer must cover the cost of returning the goods.

Procedure for handling other complaints

Please submit complaints about the availability or quality of goods by email to [email protected] or in writing to Rudzu iela 25, Dreiliņi, Stopiņu novads, LV-2130. Within 7 working days of receiving the request, the seller will send the consumer a written response to the contact address specified in the complaint and inform them of a possible way to satisfy the claim or resolve the dispute if no agreement on satisfying the consumer’s claim or an alternative remedy has been reached during that period.

If the complaint is found to be unfounded and you disagree with that finding, you have the right to use the alternative dispute resolution options provided by law by submitting a written request for out-of-court dispute resolution to the seller, stating:

  • your first name, last name, and contact information;
  • the date the request is submitted;
  • the nature of the dispute, your claims, and the grounds for them.
