TERMS OF USE

Right of withdrawal

A natural person who wishes to purchase, purchases, or may purchase or use goods or services for a purpose unrelated to their business or professional activity (hereinafter referred to as the consumer) may, under Paragraph 19 of Cabinet of Ministers Regulation No. 255 of the Republic of Latvia, “Regulations on Distance Contracts,” exercise the right of withdrawal and return purchased goods within 14 calendar days of the purchase.

To exercise this right of withdrawal, you must inform SIA “Be More” of your decision to withdraw from the above-mentioned distance contract by sending a request electronically to [email protected] or in writing to Rudzu iela 25, Dreiliņi, Stopiņu novads, LV-2130, Latvia.

Sending the request within the specified period releases the consumer from all contractual obligations relating to the distance contract concerned. The consumer must return the goods to the seller within seven days of sending the withdrawal form or request (as evidenced by the email sending date or postmark). After the goods are returned, the seller assesses their condition, prepares a refund document and sends it electronically in reply or to the address provided. If the consumer approves the contents of the refund document, the seller must refund the amount paid for the goods within seven days of receiving that approval.

Please note that the consumer cannot exercise the right of withdrawal if:

  • the price of the goods or service depends on fluctuations in the financial market that the seller cannot control and that may occur during the withdrawal period;
  • the goods are made to the consumer's specifications or are clearly personalized;
  • the goods are liable to deteriorate rapidly or expire soon;
  • the consumer has opened the packaging of goods that cannot be returned for health or hygiene reasons;
  • due to their nature, the goods have become irreversibly mixed with other parts of the goods after delivery (for example, two acrylic paints supplied separately in the packaging have been mixed);
  • the consumer has requested that the seller or service provider visit them to carry out urgent repairs or maintenance. If, during that visit, the seller or service provider provides additional services or supplies goods other than the spare parts necessary for the repairs or maintenance, the right of withdrawal applies to those additional services or goods;
  • the consumer has opened the packaging of an audio recording, video recording or computer program (this also applies to software for handheld computers, navigation devices, etc.);
  • the contract is for the supply of digital content not supplied on a tangible medium, and supply has begun with the consumer's prior express consent and acknowledgment that they will lose the right of withdrawal.

Our recommendations to avoid misunderstandings:

  • When receiving the goods, make sure they fully match your order—the manufacturer, model, color, size and other important specifications. The right of withdrawal does not apply to goods delivered by courier if a scratch or any other mechanical damage is found but was not reported immediately upon receipt. If you notice any visible damage to the packaging, please ask the courier to note it on the delivery document. This will help resolve the matter quickly if the goods themselves were also damaged during delivery! You have the right to refuse goods with damaged packaging or goods that appear suspicious at the time of delivery.
  • Inspect the goods, but do not use them.
  • Do not open the packaging of audio recordings, video recordings or computer software.
  • Keep the goods' original packaging and all included components intact.

If the consumer exercises the right of withdrawal for a reason unrelated to the goods or services failing to conform to the contract, the consumer must cover the cost of returning the goods.

Procedure for handling other complaints

Please submit complaints about the availability or quality of goods electronically to [email protected] or in writing to Rudzu iela 25, Dreiliņi, Stopiņu novads, LV-2130. Within 7 working days of receiving the request, the seller will provide the consumer with a written response, sent to the contact address specified in the complaint, and inform the consumer of a possible way to satisfy the claim or resolve the dispute if no agreement on satisfying the consumer's claim or an alternative remedy has been reached during that period.

If the complaint is found to be unfounded and you disagree with that finding, you have the right to use the alternative dispute resolution options provided by law by submitting a written request for out-of-court dispute resolution to the seller, stating:

  • your first name, last name and contact information;
  • the date the request is submitted;
  • the nature of the dispute, your claims and the grounds for them.

Within 15 working days of receiving the request, the seller will provide the consumer with a written response, sent to the contact address specified in the complaint, and inform the consumer of a possible way to satisfy the claim or resolve the dispute if no agreement on satisfying the consumer's claim or an alternative remedy has been reached during that period.
